Kajian Normatif Kerangka Regulasi Perdagangan Aset Digital : Perspektif Global dan Nasional Pada Bursa Kripto di Indonesia

Perkembangan pesat perdagangan aset digital, khususnya cryptocurrency, di Indonesia menuntut adanya kerangka regulasi yang kokoh untuk menjamin transparansi, melindungi konsumen, dan mencegah kejahatan finansial. Penelitian ini menganalisis regulasi nasional, seperti Peraturan BAPPEBTI Nomor 5 Tahun 2019, dengan membandingkannya terhadap standar global yang ditetapkan oleh Financial Action Task Force (FATF). Dengan menggunakan pendekatan normatif hukum dan analisis kualitatif, penelitian ini menemukan keselarasan parsial pada aspek lisensi dan prosedur KYC/AML. Namun, terdapat celah signifikan, seperti ketidakjelasan implementasi aturan perjalanan FATF dan klasifikasi aset kripto hanya sebagai komoditas yang terbatas. Studi kasus, seperti keterlambatan transaksi di Indodax dan maraknya skema Ponzi kripto, mengilustrasikan tantangan praktis dalam perlindungan konsumen dan pengawasan. Penelitian ini menegaskan pentingnya harmonisasi regulasi untuk meningkatkan kepercayaan pasar dan melindungi konsumen, sekaligus mengusulkan kontribusi teoretis berupa teori hibrida serta kerangka perlindungan data kontekstual.
